1. Service Description
ExportKit ("the Service") is a software-as-a-service platform that provides data export infrastructure to businesses ("Customers"). The Service enables Customers to generate streaming CSV, JSON, and Excel exports from their applications via a REST API and React SDK, with support for webhooks, email notifications, and scheduled exports.
By creating an account or using the Service, you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Acceptable Use
You agree to use the Service only for lawful purposes. You shall not:
- Use the Service to process, store, or transmit data in violation of any applicable law or regulation.
- Attempt to gain unauthorized access to the Service, other accounts, or related systems.
- Interfere with or disrupt the integrity or performance of the Service.
- Reverse-engineer, decompile, or disassemble any part of the Service.
- Use the Service to send unsolicited communications or for any fraudulent purpose.
- Exceed your plan's usage limits through automated means designed to circumvent rate limiting or usage caps.
We reserve the right to suspend or terminate accounts that violate these acceptable use policies.
3. Data Ownership
You retain all rights, title, and interest in the data you submit to or process through the Service ("Customer Data"). ExportKit does not claim ownership of Customer Data.
You grant ExportKit a limited, non-exclusive license to process Customer Data solely for the purpose of providing the Service. This license terminates when your account is deleted or when the data is removed from the Service.
ExportKit may generate anonymized, aggregated usage statistics for the purpose of improving the Service. Such statistics will not identify you or any individual.
4. Fees and Payment
4.1 Subscription Fees
Subscription fees are billed in advance on a monthly or annual basis, depending on the plan selected at the time of purchase. Your subscription automatically renews at the end of each billing cycle unless cancelled before the renewal date.
4.2 Overage Fees
If your usage exceeds the limits included in your subscription plan during a billing cycle, overage fees will be calculated and billed in arrears at the end of that cycle. Overage rates are published on the pricing page and may be updated with 30 days' prior notice.
4.3 No Refunds
All fees — including subscription fees, overage fees, and any one-time charges — are non-refundable. This applies regardless of whether you cancel your subscription, downgrade your plan, or terminate your account before the end of a billing cycle. No pro-rated refunds or credits will be issued for partial periods of use.
4.4 Payment Methods
Payments are processed through Stripe. By providing a payment method, you authorize ExportKit to charge the applicable fees. You are responsible for keeping your payment information current. Failure to pay may result in suspension or termination of your account.
4A. Automated Agent Usage & Liability
You are responsible for all usage incurred by automated agents, scripts, bots, or any other non-human process that accesses the Service using your API keys. This includes, without limitation, usage generated by AI assistants, autonomous coding tools, and orchestration frameworks.
ExportKit is not liable for costs, overage fees, or any other charges resulting from infinite loops, runaway processes, malformed agent prompts, or any other automated behavior. It is your responsibility to implement appropriate safeguards, including but not limited to spend limits, rate limiting, and monitoring of automated processes.
ExportKit provides spend limit and alert features on paid plans as a convenience. These features do not guarantee prevention of all overage charges and do not transfer liability from you to ExportKit.
5. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY THE LAWS OF THE REPUBLIC OF TÜRKİYE, EXPORTKIT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
EXPORTKIT'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNTS PAID BY YOU TO EXPORTKIT IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
NOTWITHSTANDING THE FOREGOING, NOTHING IN THESE TERMS SHALL LIMIT OR EXCLUDE LIABILITY FOR (A) FRAUD OR FRAUDULENT MISREPRESENTATION, (B) GROSS NEGLIGENCE (ağır kusur) OR WILFUL MISCONDUCT (kasıt) AS DEFINED UNDER THE TURKISH CODE OF OBLIGATIONS (LAW NO. 6098), OR (C) ANY OTHER LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE MANDATORY LAW.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the extent permitted by applicable law.
6. Termination
You may terminate your account at any time by requesting account deletion through the Dashboard or by contacting support. Upon termination, your Customer Data will be deleted in accordance with our data retention policies and Privacy Policy.
ExportKit may suspend or terminate your access to the Service at any time if you breach these Terms, fail to pay applicable fees, or if continued provision of the Service becomes impractical or commercially unreasonable.
Upon termination, your right to use the Service ceases immediately. Sections relating to data ownership, fees and payment, liability limitations, and governing law survive termination.
7. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of Türkiye, without regard to its conflict of law provisions.
Any disputes arising under or in connection with these Terms shall be submitted to the Consumer Arbitration Committees and the Courts of Istanbul (Çağlayan), Republic of Türkiye, which shall have exclusive jurisdiction.
The parties agree that mandatory consumer protection provisions under Turkish law, including but not limited to Law No. 6502 on the Protection of Consumers, shall apply where the Customer qualifies as a consumer under applicable law.
8. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you by email or through the Dashboard at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
